Terms and Conditions

1. Operator details

This website and auction platform are operated by TPCT Auction, with Tax ID and registered office at Via Ripalta Nuova 2, 26010 Ripalta Cremasca (Cremona), Italia, registered in . Contact details: info@tpctauction.com · +393337943289.

These Terms and Conditions (the «Conditions») govern access to, use of, and participation in the platform, including the conclusion of online public auction sales between sellers and successful bidders, in accordance with Spanish Law 34/2002 (LSSI-CE), Royal Legislative Decree 1/2007 (TRLGDCU), and other applicable legislation.

2. Acceptance and amendments

Registration or use of the platform implies the express, unreserved acceptance of these Conditions, the Privacy Policy, the Cookie Policy, and the Legal Notice.

TPCT Auction may amend the Conditions to reflect regulatory, technical, or operational changes. Amendments will be notified to the user at least 15 days in advance through their email address and via a prominent notice on the platform. Continued use after the entry into force of the new Conditions implies their acceptance; otherwise the user may terminate their account at no cost.

3. Services offered

TPCT Auction offers an electronic platform that enables sellers to list lots for sale through online public auction and bidders to submit binding offers. Services include, among others:

  • Hosting and publication of lots with descriptions, photographs, and grading or authentication certificates.
  • Optional in-house authentication and verification of official grades (CGC, PSA, or others).
  • Optional physical custody of lots until shipment.
  • Integrated payment management, invoicing, and shipping coordination.
  • Dispute resolution mechanisms and limited authenticity guarantees.

4. Registration and user account

Registration requires being a natural person aged 18 or over with full legal capacity, or a duly represented legal entity. The user must provide truthful, accurate, and up-to-date information and undertakes to keep it so throughout the contractual relationship.

To bid, TPCT Auction may require an identity verification process (light KYC) consisting of an official document and, where applicable, proof of address. The platform reserves the right to refuse registration or to suspend the account where there are well-founded indications of fraud, impersonation, or regulatory non-compliance.

The user is responsible for the confidentiality of their credentials and for all activity carried out from their account.

5. How auctions work

Each auction is governed by its lot listing, which sets out the starting price, minimum increments, duration, and other specific terms. Auctions run in real time according to the following rules:

  • Minimum increments: automatically calculated based on the current price band and shown when bidding.
  • Proxy bidding: the user may set a maximum bid; the system will automatically outbid rival bids by the minimum increment up to that maximum.
  • Anti-sniping: any bid placed in the final minutes before closing automatically extends the auction by the time configured in the lot listing, preventing last-second tactics.
  • Closing and adjudication: the lot is awarded to the bidder with the highest valid bid at the effective close.

6. Binding nature of bids

Every bid placed on the platform is firm, irrevocable, and binding from the moment of submission. The bidder may not withdraw, cancel, or reduce their offer once recorded by the system, save in exceptional circumstances duly evidenced and accepted by TPCT Auction.

Submitting a bid constitutes a contractual declaration of intent and commits the bidder to pay the awarded price plus applicable fees, taxes, and shipping costs if they become the successful bidder.

7. Award and contract formation

The closing of the auction and the award of the lot («virtual hammer») perfect the contract of sale between seller and successful bidder, with TPCT Auction acting as intermediary and, where applicable, depositary.

Following the award, the successful bidder will receive a notification with a summary of the transaction, applicable fees, and payment instructions. The contract is deemed formed in Ripalta Cremasca, the place of the operator's establishment.

8. Payment

The successful bidder has 5 calendar days from the award to pay the total amount through the payment methods available on the platform (card, bank transfer, wallet, supported local methods). Payments are processed by authorized payment service providers in accordance with Spanish Law 16/2009 on Payment Services.

In the event of late payment, TPCT Auction may:

  • Apply late-payment surcharges in line with commercial late-payment rules.
  • Issue a strike on the user's record. The accumulation of strikes may lead to temporary suspension or definitive cancellation of the account.
  • Terminate the contract and re-award the lot to the next-best bidder, or relist it, without prejudice to claims for damages.
  • Retain the refundable deposit, in whole or in part, where applicable.

9. Fees and taxes

Transactions on the platform are subject to the following fees, duly itemized before confirmation:

  • Seller commission: between 10% and 15% of the hammer price, depending on the lot category.
  • Buyer's premium: between 12% and 18% of the hammer price.
  • Applicable taxes: VAT at the legal rate in force on the relevant taxable base, as well as any other tax that may apply.
  • Shipping costs: calculated based on weight, volume, declared value, and destination, before payment confirmation.

All amounts are reflected on the invoice issued by TPCT Auction.

10. Shipping and delivery

Awarded lots are dispatched through professional carriers with tracking and, where appropriate, declared-value insurance. The indicative preparation period is 3-7 business days from payment confirmation. Total delivery time depends on the destination and the carrier.

The risk of loss or damage transfers to the successful bidder upon physical delivery, unless the damage is attributable to packaging or prior handling, in which case the Claims Policy shall apply.

11. Authenticity and conformity

TPCT Auction applies reasonable controls of authenticity and lot description and, where applicable, validates third-party certified grades (CGC, PSA, or others). The description published in the lot listing (including defects, restorations, grade, and provenance) prevails as a contractual element.

The successful bidder may file a complaint within 48 hours of delivery in the cases set out in the Claims Policy (carrier damage, counterfeit, material discrepancy with the description, grading failure). If the complaint is upheld, a full refund will be made to the original payment method.

12. Exclusion of the right of withdrawal

In accordance with Article 103(k) of Spanish Royal Legislative Decree 1/2007, contracts concluded through public auction are excluded from the consumer's right of withdrawal. The award is firm and binding, without prejudice to the warranties and complaints expressly provided for in these Conditions and in the Claims Policy.

13. Prohibited conduct

The user undertakes to refrain from the following conduct, the establishment of which will result in the immediate suspension of the account and, where appropriate, in legal action:

  • Shill bidding: placing bids by the seller, related parties, or controlled accounts in order to artificially inflate the price.
  • Automated sniping: use of unauthorized bots or external systems to submit bids in the final seconds.
  • Multi-accounting: creation or use of multiple accounts to circumvent restrictions, strikes, or impersonate identities.
  • Platform manipulation: attempts at mass scraping, reverse engineering, payment bypass, or exploitation of vulnerabilities.
  • Document forgery: submission of false identities, proofs, or certificates in the KYC process.

14. Liability and limitations

TPCT Auction shall be liable for damages caused to the user only where they result from the willful or grossly negligent breach of its contractual obligations. Liability for indirect damages, lost profit, loss of opportunity, or moral damages is limited to the extent permitted by mandatory consumer-protection law.

Nothing in these Conditions excludes liability that cannot be excluded under the law, in particular liability arising from the legal guarantee of conformity owed to the consumer.

15. Dispute resolution and jurisdiction

The parties shall seek to resolve any dispute arising from these Conditions amicably. To that end, the user may contact supporto@tpctauction.com to start an internal mediation procedure.

In accordance with Article 14 of Regulation (EU) 524/2013, European consumers have access to the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

Without prejudice to any mandatory consumer jurisdiction, the parties submit —expressly waiving any other— to the Courts and Tribunals of Ripalta Cremasca for the resolution of any dispute relating to these Conditions, which are governed by Spanish law.
